INVESTIGATION: Disha Salian Death Case: Why the Bombay High Court Ordered a Fresh CBI Investigation

The Bombay High Court has directed the Central Bureau of Investigation to register an FIR and conduct a fresh investigation into the 2020 death of Disha Salian after her father challenged the earlier inquiry.

What the High Court ordered

The bench directed the CBI to appoint an investigating officer, record Satish Salian’s statement, register an FIR and obtain case records from Malvani Police. The court also made clear that nobody should be treated as an accused without sufficient evidentiary grounds.

Why the earlier process was questioned

Disha Salian died on June 8, 2020, after falling from a residential building in Mumbai. Mumbai Police had registered an Accidental Death Report and later maintained that the death was suicide. Her father subsequently approached the High Court alleging investigative lapses.

The safeguard that matters

The order separates allegations from proof. It requires a substantive criminal investigation but does not declare that murder occurred or identify a guilty person.

  • The exact circumstances surrounding the death.
  • Whether the original inquiry complied with procedure.
  • Whether documentary, forensic and electronic evidence was preserved.
  • Whether evidence supports any cognisable offence.
