INVESTIGATION: Fake GST Registrations: How Stolen PAN and Aadhaar Details Can Leave Innocent Citizens Facing Tax Trouble

A growing set of court proceedings and enforcement cases points to a serious identity-theft problem inside fraudulent GST registrations: people can discover that businesses were registered using their PAN or Aadhaar details even though they never operated those businesses.

The latest Delhi High Court warning

On September 3, the Delhi High Court gave the Centre and Delhi Police a final opportunity to devise an effective mechanism against fraudulent GST registrations obtained by misusing PAN and Aadhaar details. Reporting on the proceedings said the court recorded the problem as widespread and listed the matter for September 8.

This is not only a tax problem

A person whose identity is misused can be pulled into a tax investigation for commercial activity they did not conduct. The consequences can include notices, demands, penalties and the cost of proving that the registration was fraudulent.

How the alleged mechanism works

In a Delhi case, investigators examined the mobile number used for OTPs, linked email accounts, bank information and other technical records after a complainant discovered GST firms had been linked to her PAN without her knowledge.

The enforcement gap

  • Does the applicant’s mobile number reliably belong to the PAN holder?
  • Can the system detect when a new GST registration uses an unrelated mobile number or email address?
  • How quickly is the PAN holder alerted?
  • What happens when a victim reports identity misuse but has no connection to the business?
  • How are suspicious registrations linked across multiple shell entities?

What authorities should publish

A useful accountability test would be regular public data on identity-misuse complaints, fraudulent registrations cancelled, average resolution time, tax demands withdrawn after identity theft is established, and cases referred for criminal investigation.

The cases discussed here concern specific allegations and court proceedings. The accused persons are entitled to due process, and allegations are not convictions.
