INVESTIGATION: Malda Newborn Deaths Rose to 89 in August. What the Referral Chain Must Establish

Posted on 09/04/2026 By idmahamad sekh

Malda, West Bengal | September 4, 2026: The reported death of 89 newborn babies at Malda Medical College and Hospital during August has become a wider test of West Bengal’s neonatal referral system.

The number alone does not establish negligence. Reports say many babies arrived after being referred from other facilities in critical condition. The public-interest question is where, along the chain from birth to referral to tertiary care, risk accumulated and what evidence the state will produce.

What is established

The National Human Rights Commission took suo motu cognizance on August 28 after reports that at least 60 newborns had died during the first three weeks of August. The NHRC said ten deaths were reported on one day and issued notice to the West Bengal Chief Secretary seeking a detailed report. It recorded that 44 of the first 60 babies had reportedly been referred from other medical facilities after their condition deteriorated.

Subsequent reporting put the August total at 89. An expert-cum-inquiry committee headed by Additional Director of Health Services Dr Pralay Acharya visited the hospital and met doctors, paramedical staff and administrators.

The referral chain is the first accountability question

Calling the deaths a hospital failure without examining the referral chain would go beyond the evidence. Investigators should reconstruct, for each referred newborn, the condition at first admission, treatment and stabilisation attempted, time and reason for referral, transport interval and condition recorded at Malda Medical College.

What the inquiry should publish

Clinical timelines

The state should release anonymised referral and admission intervals, broad clinical categories and birth-facility information. Patient identities are not required to establish whether delays existed.

Staffing and equipment

The inquiry should identify neonatal staffing levels and whether critical equipment was functional when required, including documented shortages and their duration.

Referral-facility findings

The inspection of 16 facilities should produce a public summary showing what investigators found.

Comparable mortality data

The August total should be compared with prior months using the same definition and population. Reported figures alone do not prove deterioration because patient volume and case severity can change. The denominator matters.

Why the NHRC intervention matters

The NHRC has formally requested a report from the state and said the reported deaths, if true, raise serious human-rights concerns. This is not a finding that doctors or the hospital caused the deaths. It is an accountability checkpoint.

Unanswered questions

  • How many of the 89 babies were born at Malda Medical College versus referred?
  • How long did referred babies wait before transfer and how long did transport take?
  • Were neonatal beds, oxygen, ventilators, warmers and trained staff available when required?
  • What did the inspection of 16 facilities find?
  • What recommendations did the expert committee make and which were implemented?

The evidence currently available does not establish that the 89 deaths were caused by negligence at Malda Medical College, nor that referring facilities caused them. Many babies were reportedly already critically ill.
